The Leader moved an amendment to Cabinet minute CA.45, Council Tax Discount – Empty Homes, recommendation (1) by deleting the words “6 months with a possible further 6 months months on review” and adding the words “up to 12 months”.   The amendment was necessary in order to comply with relevant legislation.  The Leader moved Cabinet minutes CA.46 – CA.54 and made a statement to the Council on the following matters:-

THE DECISION:

That the reports, resolutions and recommendations of the following meeting of the Audit, Governance and Standards Committee be received, approved and adopted:-

(a)     Councillor P R Wilkinson, Portfolio Holder for Economic Development and Finance made a statement regarding the prison site development.  Councillor Wilkinson announced that marketing had commenced and that the site had been given the name The Treadmills.  There would be further archaeological work undertaken in April and there would be two further open days on 21 and 28 April.  It was also announced that one long term tenant, Lidl supermarket, had signed a 25 year lease and that negotiations were ongoing for a second long term tenant.  It was envisaged that planning applications would be considered in late spring/early summer after statutory public consultation had been undertaken.  A further Members’ seminar would also be arranged.

(b)     Councillor Mrs B S Fortune, Portfolio Holder for Leisure circulated a written statement regarding the Northallerton Leisure Centre Health and Fitness project; QUEST awards; Tour de Yorkshire 2018; Community Awards; Sowerby Sports Village; Making a Difference Grants; Inclusive Sport and the MoD Covenant Project.

(c)     Councillor Mrs I Sanderson, Portfolio Holder for Governance made a statement regarding the Council’s new secure access system and wished to congratulate the Design and Maintenance team and the ICT team for delivering a successful scheme; new boundary signs were now in place around the District; the LED lighting scheme; Members’ ICT training and the judicial review on the Newby Wiske application.

(d)     Councillor D Webster, Portfolio Holder for Planning made a statement regarding the Local Plan; the GL Hearn report on the Housing and Economic Development Assessment which was due at the end of February and that the Publication Version of the Local Plan would be submitted to Cabinet in June before the statutory 6 week consultation period; Transport Modelling; staffing within the Planning Policy, Development Management and Environment Health teams; an upgrade to the Planning Portal on the Council’s website and a programmed audit of Development Control along with Enforcement and Community Infrastructure Levy by Veritau.

(e)     Councillor S Watson, Portfolio Holder for Environmental Health, Waste and Recycling made a statement regarding Waste and Street Scene; recycling; fly tipping and route re-optimisation.  It was reported that open day held for Waste and Street Scene to help recruit more staff had been successful with a good turnout and that there had been six potential candidates identified.  It was also reported that an Environment Health Officer had recently been appointed.  Due to inclement weather the waste collection rounds had been affected but normal service would resume as quickly as possible.

To consider the Motion as set out in pursuance to Minute CA.52

A revised addendum to the report had been circulated prior to the commencement of the meeting.  It was moved by the Leader and seconded by the Deputy Leader that the Notice of Motion at Item 8 on the agenda be approved in pursuance of Minute CA.52.

THE DECISION:

That pursuant to Minute CA.52:-

(1)       That it be noted that on 15 January Hambleton District Council calculated the Council Tax Base for 2018/19:-

(a)     for the whole Council area as 36,033.05  [Item T in the formula in Section 31B of the Local Government Finance Act 1992, as amended (the "Act")]; and

(b)     for dwellings in those parts of its area to which a Parish precept relates as in the attached Annex ‘A’(1) of the report.

(2)     That the Council has calculated the Council Tax requirement for the Council's own purposes for 2018/19 (excluding Parish precepts) as £3,764,733.06

(3)     That the following amounts be calculated for the year 2018/19 in accordance with Sections 31 to 36 of the Local Government Finance Act 1992:-

(a)          District/Parish Gross Expenditure

              £48,371,737.76        being the aggregate of the amounts which the Council estimates for the items set out in Section 31A(2) of the Act taking into account all precepts issued to it by Parish Councils

(b)          District/Parish Gross Income (including Government Grants, use of Reserves and Collection Fund Surpluses etc)

              £43,153,866.94        being the aggregate of the amounts which the Council estimates for the items set out in Section 31A(3) of the Act

(c)          District/Parish Net Expenditure

              £5,217,870.82          being the amount by which the aggregate at 3(a) above exceeds the aggregate at 3(b) above, calculated by the Council in accordance with Section 31A(4) of the Act, as its Council Tax requirement for the year (Item R in the formula in Section 31B of the Act)

(d)          Basic Amount of Tax (including average Parish Precepts)

              £144.8079                being the amount at 3(c) above (Item R) all divided by Item T (1(a) above), calculated by the Council in accordance with Section 31B of the Act, as the basic amount of its Council Tax for the year (including Parish precepts)

(e)          Parish Precepts

              £1,453,137.76          being the aggregate of all special items (Parish precepts) referred to in Section 34(1) of the Act (as per Annex ‘A’ of the report)

(f)           Basic Amount of Tax (Unparished Areas)

Report of the Chief Executive

The Chief Executive submitted a report seeking approval of the Statement of Pay Policy for the year commencing on 1 April 2018.  The Council was required to adopt the Statement of Pay Policy each year.

THE DECISION:

That the Statement of Pay Policy be adopted with effect from 1 April 2018.

Report of the Chief Executive

The Chief Executive submitted a report regarding the Members’ Allowances Scheme which in line with the Local Authorities (Members’ Allowances) (England) Regulations 2003 required the Council to consider its Allowances Scheme before the beginning of each year.  A copy of the proposed scheme was attached at Annex B of the report.  This scheme would cover the period 1 April 2018 to 31 March 2019.

THE DECISION:

That the Members’ Allowances Scheme for 2018/19 attached at Appendix B of the report be approved with effect from 1 April 2018.

Report of the Director of Law and Governance (Monitoring Officer)

The Director of Law and Governance (Monitoring Officer) submitted a report seeking consideration of a request to approve a dispensation for Councillor S Dickins from attending meetings of the Council, its Committees or Outside Bodies due to ill health.

Section 85(1) of the Local Government Act 1972 stated that “if a member of a local authority fails throughout a period of six consecutive months from the date of his last attendance to attend any meeting of the authority, he shall, unless the failure was due to some reason approved by the authority before the expiry of that period, cease to be a member of the authority.”

The next meeting of Council would not take place until 17 April 2018.  Therefore, it was considered that this request be made in a timely manner.

THE DECISION:

That Council approves:-

(1)     a dispensation for Councillor Stephen Dickins from attending meetings of the Council for a period of six months commencing on 28 February 2018 on the grounds of ill health; and

(2)     any extension to the dispensation for Councillor Dickins be subject to further approval at the time in accordance with recommendation (1) above.
