This report introduced the requirements of the Mobile Homes (Requirement for Manager of Site to be Fit and Proper Person) (England) Regulations 2020 (the Regulations) and sought determination of the Authority’s approach to the enforcement of these Regulations.

The reason for the decision:

 

To take account of the Regulations made under the Caravan Sites and Control of Development Act 1960 following the power in the Mobile Homes Act 2013 to create a requirement for relevant protected sites to be owned or managed by a fit and proper person.

 

The decision:

 

That Cabinet approves and recommends to Council that:-

 

(1)    the Environmental Health service enforces the requirements of the Regulations to ensure that the Council fulfils its statutory duty;

 

(2)    the implementation of the draft Fit and Proper Person Fees Policy 2021; and

 

(3)    that the Environment and Leisure Enforcement Policy be updated, and approval delegated to the Director of Environment.
