Report of the Head of Service – Environmental and Planning Services

Minutes:

The subject of the decision:

 

The Director of Environmental and Planning Services submitted a report seeking consideration of an application to vary a Premises Licence in respect of the premises situated at Great Ayton Cricket and Football Club.

 

Alternative options considered:

 

The Panel considered all of the written material on the agenda, evidence and submissions at the meeting.

 

The Panel decided to attach appropriate weight to the three late representations received after the statutory time period for submission of representations.  As similar points had already been made by other interested parties it wasn’t deemed necessary to give full consideration to the late representations.

 

The reason for the decision:

 

The Panel considered the relevant representations of the parties both written and oral, the Licensing Act 2003 as amended, the Council’s Statement of Licensing Policy, the guidance issued under Section 182 of the Licensing Act 2003 and the four Licensing Objectives.

 

THE DECISION:

 

Having considered the above matters the Panel resolved to refuse the application for the variation to the Club Premises Certificate on the ground of prevention of public nuisance as there was an increased risk to public nuisance given the proximity of the Club and its access way to residential dwellings.

 

The Panel considered alternative options to the application to address the issue of public nuisance but found the construction of the Club building was inadequate for the purposes of sound insulation in limiting noise emitting from the Club.
