Report of the Director of Environmental and Planning Services

The subject of the decision:

The Director of Environmental and Planning Services submitted a report seeking consideration of an application for the grant of a premises licence in respect of Mace Convenience Store, Exelby Services, Coneygarth, Leases Road, Leeming Bar DL7 9DD.

Alternative options considered:

The Panel considered all of the written material on the agenda, evidence and submissions at the meeting.

The reason for the decision:

The Panel considered the relevant representations of the parties, the Licensing Act 2003, the Council’s Statement of Licensing Policy, the guidance issued under Section 182 of the Licensing Act 2003 and the four Licensing Objectives.

THE DECISION:

Having considered the above matters the Panel decided to grant the premises licence.  The Panel found that the objector’s representations were primarily in relation to a nuisance issue outside the scope of the licensing remit.  In reaching its decision the Panel was mindful that no representations had been made in response to the application by the Responsible Authorities.  The Panel was not satisfied that the grant of the premises licence would have an adverse effect on the Licensing Objectives. 

The Panel noted that the premises licence was subject to monitoring by the Council’s Licensing department and could be brought back for review before the Panel if necessary.
